ON THE PROCEDURE FOR INTERNAL REPORTING OF INFRINGEMENTS
COMPANY “INCLUSIVE BULGARIA” AD
under the Law on the Protection of Persons Reporting Infringements
or Publicly Disclosing Information about Infringements (LPPRI)
This information is based on the requirements laid down in the Law on the Protection of Persons Reporting Infringements or Publicly Disclosing Information about Infringements and European legislation (2019/1937 – EU Directive on the Protection of Persons Reporting Breaches of Union Law).
The Law on the Protection of Persons Reporting Infringements or Publicly Disclosing Information about Infringements (LPPRI) aims to ensure the protection of persons who report infringements or publicly disclose information about infringements of Bulgarian legislation or acts of the European Union, which have become known to them in the course of or in connection with the performance of their work or service duties, or in another work context.
Persons who are provided protection under the LPPRI
The possibility to report an infringement through the internal reporting channel established in “INCLUSIVE BULGARIA” AD is available to a natural person (reporting person within the meaning of Art. 5, para. 2 and para. 3 of the LPPRI), who may be:
- a person who performs work without an employment relationship and/or exercises a free profession and/or craft activity, in the context of the legal relationships with “INCLUSIVE BULGARIA” AD;
- a volunteer or intern in “INCLUSIVE BULGARIA” AD;
- a partner, shareholder, sole proprietor of the capital, member of a management or supervisory body of a commercial company, member of the audit committee of an enterprise that has had or is in the process of entering into legal relationships with “INCLUSIVE BULGARIA” AD;
- a person working for a natural or legal person, its subcontractors or suppliers, who is in a legal relationship with “INCLUSIVE BULGARIA” AD;
- a job applicant who has participated in a competition or other form of selection for employment in “INCLUSIVE BULGARIA” AD and has received information about an infringement in that capacity;
- a worker or employee, when the information has been obtained within the framework of an employment or service relationship with “INCLUSIVE BULGARIA” AD, which has been terminated at the time of reporting the signal or public disclosure.
- any other person who reports an infringement in “INCLUSIVE BULGARIA” AD that has become known to him in a work context.
How you can report an infringement.
- In person, to the responsible person at the office of “Kolekt Services Group” OOD with UIC 203210899 at the address in Sofia, Ovcha Kupel District, Ovcha Kupel Residential Area, “Naroden Geroi” Str. No. 2, building “A”, ground floor, office 1;
- By courier with a package to the office of the person responsible for receiving the signals “Kolekt Services Group” OOD with UIC 203210899 at the address: Sofia, Ovcha Kupel District, Ovcha Kupel Residential Area, “Naroden Geroi” Str. No. 2, building “A”, ground floor, office 1, on which under the address of the recipient is written the text “Signal under LPPRI”. The package is handed over immediately to the employee responsible for reviewing the signals to “INCLUSIVE BULGARIA” AD;
- By e-mail, to the address: ksg.zzlps@abv.bg;
* Written signals are signed by the persons who submit them. When submitting electronically, the form is signed with a qualified electronic signature.
You can submit an oral signal on the phone +359 877410790 including through a voice messaging system, or through a personal meeting with the responsible person, which you have agreed upon in advance on the specified phone.
In these cases, the responsible person will fill in the data in the standard form and will give you the opportunity to check, correct and agree with the text of the conversation in writing, as well as with the content of the form, which you will sign.
*You can attach any kind of information sources supporting the statements you have made, and/or references to documents, including indicating data on persons who could confirm the reported data or provide additional information.
! You should fill in all the data in the form.
In case the signal does not meet any of the requirements, the responsible person shall notify the person who submitted the signal to remedy the irregularities within 7 days. If the irregularity is not remedied within this period, the signal together with the attached documents shall be returned to the person who submitted it.
The employee responsible for the signal will provide feedback on the actions taken within a period not exceeding 3 months after confirming the receipt of the signal.
The identity of the reporting person and of any other person mentioned in the signal will be duly protected and the necessary measures will be taken to limit access to the signal by unauthorized persons.
! Anonymous signals, as well as signals relating to infringements committed more than two years ago, will not be initiated.
